Signature Assignment Description/Directions:
United States Code Title 42 § 1983 protects citizens of the United States, and those within the jurisdiction, from deprivation of their Constitutional rights under color of law. While some might believe civil jeopardy only applies to field officers, police and correctional managers are also held liable when the injured party is affected by the acquiescence or acceptance of subordinates’ actions.
Read the civil rights claim instructions for the Third Circuit Court of Appeals (2014), sections 4.6.1. through 4.6.8. You will write a plan to address hiring, training, and promotion within a police agency and the potential for liability. Consider the following areas of jeopardy for supervisory personnel:
Failure to Train
Failure to Adequately Screen during Hiring
Failure to Supervise
As part of your review of proposed hiring, training, and supervisory qualification standards as related to promotion, read the US DOJ article (Davis, Whyde, Langton, 2018) on police contacts. Based on your local demographics and use of the statistical information in the report, explain how the three parts of your plan address the report findings. Additionally, as a reflective component, explain how your plan assists in overall police department operations.
