Thais DeMarco was a Portuguese-speaking worker in the kitchen of the Little Sisters of the Poor Nursing Home. Christine Darragh was the new food director at the home. Darragh told DeMarco to clean the counters with a cleaner she purchased from a chemical supply vendor. Darragh, who did not speak Portuguese, instructed DeMarco to pour the cleaner from the bottle and wipe down the counters.
The cleaner was strong and it irritated DeMarco’s hands (Darragh had not instructed her to wear gloves). To avoid more irritation, DeMarco decided to add water to dilute the chemical without knowing what effect it would have. The addition of water caused toxic fumes which DeMarco then inhaled causing lung damage.
Darragh was contacted by OSHA about the incident. OSHA then cited the Nursing Home for and SDS violation and fined the company. Darragh indicated that the SDS sheets were available.
