The police are investigating Herman Goering for manufacturing and distributing methamphetamine and fentanyl from his residence at 123 Maple Street here in Albuquerque. They begin surveillance by getting a high-lift bucket truck and posing as tree trimmers so they can look onto Goering’s property. They use telescopic lenses to get a better view. Based on people coming and going, plus what they see through the windows, the investigators get a warrant to place a tap on Goering’s cell phone and access his call log. They use a thermal imager to get a warrant to search the residence at 123 Maple to look for drugs and equipment. There are no outbuildings.
An undercover officer poses as a drug buyer and goes to Goering’s house. Standing outside on the front walk, the officer talks with Goering. The officer asks for some meth. Goering goes inside and comes bag with a small baggie full of a powdery substance. He takes $250 in marked money from the officer. The substance tests are positive for meth. Based on this information, the investigators amend their request for the warrant, and the judge grants it.
Investigators search the residence and find a considerable number of drugs, plus cooking and manufacturing equipment.
Goering is arrested but claims he was entrapped by the investigators.
