After a lengthy investigation,<br \/> the FBI obtains an arrest warrant for Ricky for wire fraud. After surveilling<br \/> Ricky for some time, the FBI determines he is currently staying at his<br \/> mother\u2019s. When the FBI arrives at Ricky\u2019s mom\u2019s house, Ricky quickly surrenders<br \/> without incident. The FBI agents then search Ricky\u2019s mother\u2019s house, over her<br \/> vigorous objections, repeatedly telling the agents they are not allowed to<br \/> search and to stop immediately. During the search, agents find evidence<br \/> throughout the house that Ricky\u2019s mother has been trafficking cocaine,<br \/> including bags of cocaine in her freezer and bedroom dresser drawers, and scales,<br \/> baggies, and other packing materials on the kitchen counter. They then arrest<br \/> Ricky\u2019s mom based on this evidence. Later, in a pre-trial motion, Ricky\u2019s mom<br \/> seeks to exclude the evidence seized at her home as obtained in violation of<br \/> the constitution. <\/p>\n<p> Please analyze this fact<br \/> pattern and evaluate the likelihood that Ricky\u2019s mom will be successful in her<br \/> motion to exclude the evidence. They<br \/> surprise Bowen with the fresh cookies and offer him some. Once given the<br \/> cookies, Bowen\u2019s demeanor changes and he becomes much more agreeable. After<br \/> Bowen has a few cookies, he becomes nostalgic and remarks that these cookies<br \/> are just like Shana used to make. Officer Henderson begins to engage Bowen<br \/> about Shana and gets Bowen to agree that she was a good and honest person who<br \/> always \u201cdid the right thing.\u201d After this exchange, Officer Henderson asks Bowen<br \/> if he would honor Shana\u2019s memory and \u201cdo the right thing\u201d by telling the truth<br \/> about his involvement in the burglary. After a few moments of reflection, Bowen<br \/> tearfully confesses to the crime. Bowen is subsequently charged with burglary,<br \/> a felony, and is remanded by the judge to the county jail pending trial. <\/p>\n<p> \u00a0 <\/p>\n<p> Before trial, Bowen seeks to<br \/> have his confession excluded from evidence.
