The Issue must be expressed in the form of a legal question which, when answered, gives the result in the case. Make it specific (e.g. \u201cHas there been a false imprisonment if the plaintiff was asleep at the time of \u2018confinement\u2019?\u201d) rather than general (e.g. Did the defendant owe a duty of care to the plaintiff when the plaintiff was trespassing on the defendant\u2019s property?). Some cases present more than one issue; if there is more than one issue, it is OK to write more than one, but be sure to list the principal one and focus on that. <br \/>Rule: The Rule is the law that applies to the principal issue. It should be stated as a general <br \/>principal, (e.g. A duty of care is owed whenever the defendant should anticipate that her conduct could create a risk of harm to the plaintiff.) not a conclusion to the case being briefed, (e.g. \u201cThe plaintiff was negligent.\u201d). Typically, the Rule can be expressed in one or two sentences. <br \/>Application: The Application is a discussion of how the Rule applies to the facts of the case. Essentially, the Application section is a description of the relevant facts, the parties\u2019 arguments and positions in the case, and the court\u2019s thought process by which it answered the Issue and established the Rule. While the Issue and Rule are normally only one or two sentences each, theApplication section of a brief should be two to four paragraphs long. It should be written debate, not simply a statement of the Conclusion. Whenever possible, present both sides of any issue. Do not begin with your Conclusion. The Application section shows how you can track the court\u2019s reasoning on paper and is the most difficult skill you will learn. It is also permissible to put the relevant facts of the case in a separate section of the Brief. <br \/>Conclusion: What was the result of the case? Did the appellate or supreme court affirm, reverse or reverse and remand the lower court\u2019s decision? <br \/>4 Questions below: <br \/>QUESTION 1: <br \/>Ginger and Rodger are partners in a computer animation firm. Ginger retires from the firm, but tells Rodger that he can leave hername on the entrance door to the firm and in the telephone listing. Alec, a new client, visits the firm after telephoning the firm.Alec has seen Ginger&#8217;s name listed in the phone book along with Rodger&#8217;s and the firm&#8217;s names. He also sees Ginger&#8217;s name on the entrance door to the firm. Believing Ginger is a partner with Rodger, Alec contracts to have the firm develop animation for his upcoming film. Rodger, however, never performs the contract. Alec sues Rodger and Ginger. <br \/>Is ginger liable to Alec? <br \/>QUESTION 2. <br \/>Nathan Campos is a partner of Bright Top LLP, an accounting limited liability partnership. One of Campos&#8217; partners negligently audits a client, with the result that a bank that relied on the client&#8217;s audited financial statements suffers damages when the client fails to repay the loan. The bank sues Bright Top, but its assets are insufficient to pay the entire damages. <br \/>(20%) In Bank v. Bright Top LLP and Campos, what result? Discuss fully. <br \/>QUESTION 3: <br \/>Yossef, Jasmine, and Conrad are partners of Canyon Associates. The term of the partnership is 5 years, but Conrad withdraws after 1 year because he no longer wished to continue. <br \/>(20%) Discuss fully the nature and consequences of Conrad&#8217;s dissociation. <br \/>QUESTION 4: <br \/>Tyler is the sole general partner in XYZ Limited, a limited partnership. There are five limited partners. One day, Tyler went to the grocery store to purchase groceries for himself. He forgot his personal checkbook. However, he had the partnership&#8217;s checkbook.
