The CSA classifies marijuana as a schedule 1 controlled substance.

Owing to this law, it is a crime to sell, grow, or possess marijuana. The CSA is important as it gave direction on how law enforcement agencies should manage drug trafficking and drug abuse cases (Mead, 2019). It also reduced cases of over-prescription of drugs such as morphine and cocaine.

Thesis Statement: Although the formulation of CSA had good intentions, the policy has gaps that have limited its effective control of marijuana.

Topic Sentence: Poor marijuana regulation arises due to CSA unclear classification.

i) Marijuana is generally classified by the federal law as hemp or marijuana.

ii) According to the CSA, the cannabis plant and its derivates are all referred to as marihuana, a term that was commonly used in 1970 when the act was being formulated (Congressional Digest, 2022).

iii) The Act has a limitation in that it excludes products that meet the definition of hemp

iv) The CSA also fails to include marijuana components that has been extracted from the plants’ oils, fibers, seeds, and stalks.

Topic Sentence: CSA encounters competing interests during drug regulation

CSA controls both medical and recreational products that pose a risk of abuse or dependence.

CSA acknowledges that there are several products that have useful medical purposes and used in maintenance of the health and general wellbeing of the people (Kamin, 2019).

There are also products whose importation, manufacturing, and possession poses a public risk due to their propensity for abuse and dependency.

Marijuana is one of the products, which has medicinal use, but its access needs to be controlled for legitimate purposes.

The CSA and law enforcement officials in several states in the U.S have no clear guide on how to protect public health by promoting access of marijuana and limit its access for individuals that would like to abuse it (Kesler, 2019).

Topic Sentence: Removal of marijuana from the schedule I category of the CSA.

As a schedule I product, there is a dispute on the CSA Act should be interpreted and whether there is sufficient scientific evidence to support its classification of schedule I.

The U.S government postulates that marijuana is a dangerous product; hence, warrants classification as a schedule I controlled substance.

However, there are proponents who believe that it does not meet the strict criteria of the CSA’s act.

The government spends huge sums of money in regulating marijuana use.

The government can generate revenue by controlling its use and amplifying the medical use of marijuana.

Conclusion

The CSA has essential guidelines for controlling the use of controlled substances.

However, the control of marijuana through its classification as schedule I product creates gaps.

Some states have legalized marijuana use and other states should benchmark from the to learn and improve the regulations.

The CSA guidelines should be reviewed for better enforcement.

References

Congressional Digest (2022).
