Please carefully consider the
following fact pattern:
Ricky, 35, has been running a
fraudulent online business offering legal assistance to immigrants seeking to
obtain lawful permanent resident (“green card”) status in the U.S. Apart from
Ricky not being a licensed attorney or otherwise authorized to provide legal
services, the business is merely a scheme to defraud customers of their money
under the false promise of immigration benefits. After a lengthy investigation,
the FBI obtains an arrest warrant for Ricky for wire fraud. After surveilling
Ricky for some time, the FBI determines he is currently staying at his
mother’s. When the FBI arrives at Ricky’s mom’s house, Ricky quickly surrenders
without incident. The FBI agents then search Ricky’s mother’s house, over her
vigorous objections, repeatedly telling the agents they are not allowed to
search and to stop immediately. During the search, agents find evidence
throughout the house that Ricky’s mother has been trafficking cocaine,
including bags of cocaine in her freezer and bedroom dresser drawers, and scales,
baggies, and other packing materials on the kitchen counter. They then arrest
Ricky’s mom based on this evidence. Later, in a pre-trial motion, Ricky’s mom
seeks to exclude the evidence seized at her home as obtained in violation of
the constitution.
Please analyze this fact
pattern and evaluate the likelihood that Ricky’s mom will be successful in her
motion to exclude the evidence. For your response, please provide a complete
analysis of all the relevant issues. Please explain in detail why you believe
she will have her motion granted or dismissed. Your response should include

Discussion 3.1Bowen is in police custody and
under interrogation for the suspected crime of burglary. During the initial
investigation of the crime, police learn that Bowen had been married for many
years to Shana and that the couple had a very close and loving relationship
before Shana suddenly passed away three months ago. Police also learned that
Shana would make Bowen his favorite chocolate chip cookies for his birthday
each year.
After the questioning of Bowen
regarding the alleged burglary reached an impasse, the police arrange to have a
fresh batch of chocolate chip cookies baked and delivered to the station. They
surprise Bowen with the fresh cookies and offer him some. Once given the
cookies, Bowen’s demeanor changes and he becomes much more agreeable. After
Bowen has a few cookies, he becomes nostalgic and remarks that these cookies
are just like Shana used to make. Officer Henderson begins to engage Bowen
about Shana and gets Bowen to agree that she was a good and honest person who
always “did the right thing.” After this exchange, Officer Henderson asks Bowen
if he would honor Shana’s memory and “do the right thing” by telling the truth
about his involvement in the burglary. After a few moments of reflection, Bowen
tearfully confesses to the crime. Bowen is subsequently charged with burglary,
a felony, and is remanded by the judge to the county jail pending trial.
Before trial, Bowen seeks to
have his confession excluded from evidence. Please evaluate the arguments Bowen
could make to exclude his confession and the likelihood of success on each.

Discussion 3.2
The New York City Police
Department (NYPD) stops and frisks thousands of individuals each year. Several
organizations claim that during many of these stop-and-frisk encounters, the
rights of individuals to be free from arbitrary and unwarranted intrusions by
government authority conflicts with the duty of law enforcement to prevent
crime and apprehend criminals. Put another way, some believe that the
stop-and-frisk policy results in excessive infringements on the rights of
individuals to be free from police intrusions, while others believe that the
policy is justified in the interests of maintaining law and order in the city.
Please evaluate the NYC
stop-and-frisk policy in light of what you have learned in this module about
Terry stops, and what you gather from your research about how stop-and-frisk is
implemented in the city. Please consider the positive and negative aspects of
the policy and provide at least two recommendations to NYC for changes to
current practice you would like to see implemented and explain why.
