A federal grand jury indicted six managers of the company with a conspiracy to cheat the government by engaging in a fraudulent marketing, sales and billing scheme to increase the sales of prescription drugs. In 2001, the company entered into a settlement agreement with the federal government.
The terms of the agreement included many of the ethical cultural elements that were covered in this lesson.
- The company agreed to review its disciplinary procedures, to meet its goals of continuing to promote high ethical standards in the conduct of its business practices, and to revise and redistribute its code of business conduct.
- Also, the company agreed to require its employees to receive training and education in the proper methods and practices of promoting, marketing and selling products, and to review its reporting practices, sales and marketing systems, policies and procedures regarding sales and marketing activities.
- Finally, the company agreed to maintain, on a non-retribution, non-retaliation basis, its disclosure program with a mechanism to enable individuals to disclose anonymously and confidentially any identified issues or questions associated with its policies, conduct, practices or procedures.
As you reflect on the case, comment on the ethical environment at Tap Pharmaceuticals and the lack of essential elements of ethical culture in the organization. Address all the questions in the case. In your comment, apply each of the ethical principles from the Ethical Organizational Culture Module (reference “Ethical Cultural Elements, Figure 6.2 in course content). Refer to Lesson 6 content, covered in lesson commentary, readings, and videos.
